Terms of Service.

These Terms of Service ("Terms") govern your use of Atharly's website, dashboards, SDKs, and related services (the "Service"). By creating an account, accessing the dashboard, or integrating an Atharly SDK into your own application, you agree to these Terms. If you do not agree, do not use the Service.
1. Agreement
If you are entering into these Terms on behalf of an organisation, you represent that you have authority to bind that organisation. In that case, "you" means both you personally and the organisation.
2. The Service
Atharly provides mobile attribution, deep-linking, and event-tracking infrastructure operated from the Kingdom of Saudi Arabia. The Service includes:
- A control plane and dashboard at dash.atharly.com.
- HTTP APIs for ingesting click, install, and event data.
- Software development kits ("SDKs") for iOS, Android, and the web.
- Documentation and support.
We may change, add, or remove features over time. We will not materially reduce the functionality of any paid plan during a billing period without notice.
3. Your account
To use the Service you must create an account, provide accurate information, keep your credentials confidential, and notify us promptly if you suspect unauthorised access. You are responsible for activity that takes place under your account.
You must be at least 18 years old. The Service is provided to businesses and is not intended for consumer use.
4. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose, or in violation of any applicable Saudi or international law.
- Misrepresent the source of attribution data, fabricate clicks, installs, or events, or otherwise manipulate the matcher to inflate or distort attribution outcomes.
- Use the SDK to collect categories of data the SDK is not designed to collect (clipboard contents, advertising identifiers, biometric data, precise geolocation, etc.).
- Attempt to reverse-engineer the SDK or platform, except as expressly permitted by Saudi law.
- Probe, scan, or interfere with the platform's security or availability.
- Resell, sublicense, or white-label the Service without a separate written agreement with Atharly.
- Send spam, phishing, malware, or any unsolicited communications using attribution data we processed for you.
We may suspend or terminate accounts that violate this section.
5. Free plan and paid plans
The Free plan includes 20 active links and 1,000 events per calendar month per tenant. We may change Free-plan limits with 30 days' notice. Paid plans are governed by a separate Order Form or service agreement; if there is a conflict between an Order Form and these Terms, the Order Form prevails.
6. Your data
You retain all rights to the data you upload, ingest, or generate using the Service ("Customer Data"). You grant Atharly a limited, worldwide licence to host, copy, transmit, display, and process Customer Data solely to provide and operate the Service for you.
We will not access your Customer Data except to operate the Service, debug a problem you've raised with us, or comply with legal process.
7. Our intellectual property
The Service — including the platform, dashboard, SDKs, documentation, and the "Atharly" trademarks — is and remains the property of Atharly. We grant you a non-exclusive, non-transferable licence to use the Service in accordance with these Terms during your subscription. The licence terminates when your subscription ends.
8. Privacy
Our handling of personal data is governed by our Privacy Policy. You acknowledge that you have read it.
If you process personal data of end-users through the Service, you act as the Data Controller under PDPL and Atharly acts as your Processor. Where applicable, the Data Processing Addendum referenced in your customer agreement forms part of these Terms.
9. Service availability
We aim for high availability but do not guarantee uninterrupted access. Paid plans may have a separate Service Level Agreement; if one is in effect, it governs availability commitments and any associated remedies.
10. Suspension and termination
You may close your account at any time from the dashboard. We may suspend or terminate your account on notice if you breach these Terms, fail to pay, or use the Service in a way that materially harms us, our other customers, or third parties.
On termination we will provide you with a reasonable opportunity to export your data, then delete it in accordance with our Privacy Policy.
11. Disclaimers
The Service is provided "as is" and "as available". To the maximum extent permitted by law, Atharly disclaims all warranties — express, implied, statutory — including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Attribution outcomes are probabilistic. Atharly does not warrant that any specific install, click, or event will be matched, attributed, or returned with any specific confidence score.
12. Limitation of liability
To the maximum extent permitted by law, Atharly's aggregate liability for any claim arising out of or related to these Terms or the Service will not exceed the amount you paid us in the 12 months before the event giving rise to the claim, or 100 SAR, whichever is greater.
In no event will Atharly be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, lost goodwill, or business interruption — even if advised of the possibility.
13. Governing law and disputes
These Terms are governed by the laws of the Kingdom of Saudi Arabia. Any dispute arising from these Terms or the Service will be settled by the competent courts of Riyadh.
14. Changes to these Terms
We may update these Terms occasionally. The "Last updated" date at the top reflects the most recent change. If a change materially reduces your rights, we will notify you at least 30 days in advance through the dashboard and via email. Your continued use of the Service after the effective date constitutes acceptance.
